Cloud Customs – Terms and Conditions

Welcome to Cloud Customs (“CloudCustoms”, “we”, “our”, or “us”), a specialized online platform that connectsbuyers and sellers of automotive parts, tools, accessories, and cloud-basedautomotive services.

These Terms and Conditionsgovern your access to and use of the Cloud Customs website, mobileapplications, and all related services (collectively, the “Platform”). Byaccessing or using our Platform, you agree to be bound by these Terms andConditions, our Privacy Policy, and all applicable laws.

If you do not agree to these terms,please do not use our services.

1.User Eligibility

To use our Platform, you must:

• Be at least 18 years old or have reached the age of     majority in your jurisdiction.
• Register and maintain an accurate and truthful user     account if engaging in buying or selling activities.

We reserve the right to restrict orterminate access to the Platform at our sole discretion.

2.Account Registration and Management

• Users must provide accurate, complete, and up-to-date     information during registration.
• You are solely responsible for maintaining the     confidentiality of your login credentials.
• You agree not to share your account or password with     any third party.
• We are not liable for any loss or damage arising from     unauthorized access to your account.

Cloud Customs may suspend or deleteaccounts for violating platform policies or applicable laws.

3.Use of the Platform

You agree to:

• Use the Platform only for lawful purposes and in     accordance with these Terms.
• Not misuse, disrupt, or exploit any part of the     Platform or its services.
• Not upload or distribute false, misleading, defamatory,     infringing, or harmful content.
• Not impersonate any person or entity, or falsely state     or misrepresent your affiliation.

We reserve the right to removecontent, cancel transactions, or restrict access for any behavior that violatesthese Terms or harms the platform ecosystem.

4.Buyer & Seller Responsibilities

Buyers

• Ensure product information, including specifications     and compatibility, is understood before purchasing.
• Provide accurate delivery and contact information.
• Make prompt payment through approved methods.
• Cooperate with sellers regarding shipping, returns, and     support requests.

Sellers

• List products/services truthfully and in compliance     with local and international trade laws.
• Honor shipping timelines, product quality, and     return/refund policies.
• Avoid selling counterfeit, restricted, or stolen     products.
• Resolve disputes professionally and in good faith.

5.Transactions and Payments

All transactions must be conductedthrough the Cloud Customs platform using approved payment methods. CloudCustoms may offer payment protection features (e.g., escrow or milestonepayments) depending on the transaction type.

We are not liable for any losses dueto direct transactions made outside the Platform.

6.Fees and Commissions

Cloud Customs charges sellers acommission fee on each completed transaction, based on product categories andservices. Additional fees may apply for premium listings, advertising, orplatform services.

Fee details are available in yourSeller Dashboard or upon onboarding.

7.Intellectual Property

• You retain rights to any content you upload to the     Platform.
• By posting on Cloud Customs, you grant us a worldwide,     non-exclusive, royalty-free license to use, display, distribute, and     promote your content on the Platform.

You may not use Cloud Customs'trademarks, logos, or proprietary materials without our written consent.

8.Privacy and Data Protection

We collect, use, and share yourpersonal information in accordance with our Privacy Policy. By using our Platform, youconsent to such data processing.

You are responsible for safeguardingthe privacy of other users’ data accessed through the Platform and must complywith all relevant privacy laws.

9.Dispute Resolution

Cloud Customs encourages parties toresolve disputes through our mediation system before taking legal action. Ifunresolved, disputes may be escalated to arbitration or settled in accordancewith the governing law (see Section 13).

We reserve the right to mediate ortake corrective actions on behalf of users to maintain trust and platformintegrity.

10.Termination

We may suspend or terminate accessto the Platform for:

• Breach of these Terms and Conditions.
• Violation of laws or third-party rights.
• Fraud, misrepresentation, or suspicious activities.

You may close your account at anytime. Upon termination, certain rights and obligations will continue (e.g.,payment of fees, outstanding claims).

11.Platform Modifications

Cloud Customs reserves the right to:

• Modify or discontinue any aspect of the Platform at any     time.
• Revise these Terms and Conditions with or without     notice.

Your continued use of the Platformafter any changes constitutes acceptance of the updated terms.

12.Limitation of Liability

To the maximum extent permitted bylaw:

• Cloud Customs shall not be liable for any indirect, incidental,     special, or consequential damages.
• Our total liability for any claim under these Terms     shall not exceed the amount paid by you to us in the last 6 months.

13.Governing Law and Jurisdiction

These Terms shall be governed by thelaws of USA. Any disputes arising from or in connection with these Terms shallbe subject to the exclusive jurisdiction of the courts located in USA.
